Brazil Supply Chain Due Diligence Bill

Brazil is one of the few countries in the Global South developing its own supply chain due diligence legislation. Bill PL 572/2022 proposes to require large Brazilian companies to conduct human rights and environmental due diligence across their domestic and international supply chains. The bill explicitly draws on the French Duty of Vigilance Law and the UN Guiding Principles on Business and Human Rights.

The bill has advanced through several committees in the Brazilian Chamber of Deputies and has now moved to the Environmental Committee. Passage remains uncertain given the complexity of the legislative environment, but the bill has significant civil society support and the attention of major Brazilian business associations who are watching European developments closely.

If enacted, a Brazilian due diligence law would be a landmark development, representing one of the first comprehensive HREDD frameworks in the Global South. It would also create new obligations on Brazilian companies operating in other developing countries, affecting supply chains across Latin America and parts of Africa.

    Human rights and environmental due diligence (proposed)

    Large Brazilian companies would be required to conduct due diligence on human rights and environmental risks in their operations and supply chains.

    Companies would need to publish and implement a vigilance plan, modelled on the French Duty of Vigilance approach.

    Companies that fail to exercise adequate vigilance and cause harm could face civil liability under the proposed law.
